Hi all,


If a company is purchasing a car, can the registration be in the name of the director, however the invoice and finance are all in the name of the company, therefore only the registration will be in the directors name would I still be able to claim the GST credits under the company and depreciate the car under the company?

If the director’s name is on the rego, the ATO might suspect the car is used personally, and FBT may apply. To avoid issues, ideally:

  • The registration should also be in the company’s name (or at least explainable).
  • All other documents (invoice, finance, insurance) should clearly show the company.
  • Keep a logbook to substantiate business vs private use.
  • Consider FBT implications if a director uses the car personally.

the company may have to set up a lease agreement on commercial terms with the director.
