Hi,


I recently paid my body corporate fees late and now owe a late fee of $342. I am wondering whether this late fee is tax deductible or if it should be treated as non deductible.


I came across a statement that says, "Non Statutory bodies are not permitted to impose penalties. They can charge you, for example an admin fee or a late payment fee but these are not classified as fine for Australian tax purposes and thus, are deductible."


Could you please clarify whether the late fee in this case is deductible for tax purposes?

(By the way I'm running a business as sole trader)

Sadly, no. While regular body corporate fees for maintenance may be deductible, late fees are seen as a financial slap on the wrist rather than an income-generating expense. Paying late is not a tax deduction, sorry!

It would be better for your Body Corporate to set levies with an early payment option. The levy is set accordingly. Pay early and receive the discount.

Pay "on time" eg 1 July, and no discount.

Pay early eg 30 June, receive the discount, and claim the payment in your tax return (if it is an investment property).
