Hi, I have a question. If I earn enough for my super guarantee amount to be higher than the annual concessional cap, can I request that difference to be paid to me as salary instead?

Your employer is obliged to pay the SG rate on your Ordinary Time Earnings (OTE) up to the quarterly Maximum Contribution Base, as per the ATO guidance. Even if that amount exceeds your concessional cap amount.
Seek assistance from the Fair Work Ombudsman for questions about your employment entitlements and pay.
