Hi,

I have a court case going on in the US after a fatal car accident. I was wondering if I have to pay tax on the compensation?

If you're an Australian resident for tax purposes, you usually need to declare any foreign income, including compensation from a US court case. But whether it’s taxable depends on what the payment is for. If it’s for:

  • personal injury or death, it’s usually not taxable
  • lost income, interest or punitive damages, that part may be taxable.


If you’re not a resident for tax purposes, you may not need to report foreign-sourced income in Australia.
