HI everyone, my question is, I took some of my superannuation under compassionate grounds for weight loss surgery, during the process of applying and getting my application approved and funds into my bank account I gained some weight and now is not safe to undertake the surgery and I really don't want to go ahead with it, does anyone know how I be penalised from the tax department or if there is anyway I can't get out of this without facing any consequences.

I'm not sure what penalty you think you're going to get?


If you provided the correct documents to get approved and you were approved, you've therefore done nothing wrong.


Your application was processed and approved with no wrongdoing. There's no penalty if you cannot medically use it for it's intended purpose.


You will have to declare it in next years tax return though and possibly pay tax on it, but that would've happened regardless of what it was used for. 👌
