Hi all

I am an employee of one of the allied health care provider business which is operates as a discretionary trust. My ato income statement shows The trustee of “entity name (not disclosing for privacy)” what does it mean? My employer seems very fishy does not pay my super on time and does not report the income as it should. If I am acting as trustee of one company and receiving income then does it attract to sign any trust deed or declaration? Does my employer should take my consent to appoint me as a trustee ? Or employer have legal obligation to do all these things backhand without providing any info to employee?

Any help would be appreciated.

When your ATO income statement lists your employer as “The Trustee of [Entity Name]”, it means that your employer is a trust, not a company in its own right.

A trust is a legal structure where a trustee (either a person or a company) holds and manages assets or runs a business on behalf of beneficiaries.


In your case:

  • The “entity name” is likely the trust’s name.
  • “The trustee of [entity name]” is the employer’s legal entity that operates the business -possibly a corporate trustee (like “XYZ Pty Ltd as Trustee for ABC Trust”).

So, this line on your ATO income statement does not mean you are a trustee. It just means your employer is operating through a trust.


You can report any possible breaches of superannuation or tax law to the ATO if you have concerns your employer isn't doing things correctly.

No, your employer can't legally make you a trustee without your knowledge or consent. You don’t become a trustee just by working for a trust. You must sign and be given access to a copy of a trust deed or declaration to be legally appointed. If you think someone has forged your signature or appointed you without permission, you should seek legal counsel.


Based on what you’ve said, it sounds like the trustee is a corporate trustee and likely registered with ASIC and has an ABN (you can confirm their registration status through ABN lookup).


Depending on how the business is set up, things like GST and PAYG withholding might be reported under the trustee’s name instead of the trust itself.


If you’re worried your employer is intentionally doing the wrong thing, you can make a tip-off to us. If your employer isn’t paying your super on time or correctly, it’s best to talk to them first. If the problem continues, you can report the unpaid super to us.
