We are paying rent with GST for a commercial property.


When we asked for the landlords ABN number and GST registration status for the company listed on the lease. No ABN number or GST registration record is available.


Instead, we were provided information and an ABN with GST registration that is from a separate entity to what is on the lease.


Can we be charged GST using an ABN that is a separate entity which is not on the lease?

If you're being charged GST on commercial rent, the entity charging it must be registered for GST and must be the one supplying the lease. That means the ABN and GST registration should match the entity listed on the lease agreement.


If the ABN provided belongs to a different entity than the one named on the lease, it raises concerns about whether the GST is being correctly applied. GST must be charged by the entity that is legally making the taxable supply. Using an ABN from a separate entity that isn’t listed on the lease could mean the GST is being incorrectly charged.


You can check an ABN’s GST registration status using the ABN Lookup and compare it with the entity named on your lease. If they don’t match, it’s worth asking the landlord for clarification or seeking advice to ensure the GST treatment is correct.
