Im under the Schads award and having difficulty understanding what my employer should be paying into my super fund.


Basically I'm not getting super paid on a large chunk of my roster.


I work 18hrs Monday to Friday but when Sat/Sun comes I do a lot of shifts and a sleepover.


I start at sat 9.30am work until 4pm, start another job with the same employer 5.30pm sat to 1pm Sunday(Including sleepover), I then have a 5hr break and do another 2 hours.


My employer is classifying everything from 5.30pm Sat including Sunday as Overtime and following that exemption from super payments.


Is this correct even tho these hours are the same all the time? Is the Schads award that messed up that employers can find loop holes not to pay super?

Hi @Gibson,


Whether your Saturday and Sunday shifts should have super paid on them depends if they're part of your ordinary hours or genuine overtime. If the weekend shifts are part of your regular roster and happen consistently each week, they may count as ordinary hours.


Under super guarantee rules, you're entitled to super on your ordinary time earnings. Your employer doesn't have to pay super on genuine overtime hours that are over and above your ordinary hours.


Sleepover allowances are usually not considered OTE unless you’re paid for active work during that time. If you’re paid a flat allowance for sleeping over, that amount generally isn’t subject to super.


If you think your employer is misclassifying ordinary hours as overtime to avoid paying super, you can check the definition of ordinary hours in your award and employment contract. The Fair Work Ombudsman can also confirm what counts as ordinary hours under the SCHADS Award.
