Co-worker has sick child in hospital interstate and no leave left so has to stay at work to cover expenses. Members of the team would like to donate some of their banked recreational leave entitlement to help out.

Firstly, leave entitlements are defined in the industrial instruments, such as awards and agreements. Those industrial instruments define how the leave entitlements may be paid: as an absence, cashout in service and upon termination. They are not transferable.


Perhaps you might seek support from your employer to extend to your colleague the period of paid leave or to take the leave in advance of entitlement? Otherwise, the Fair Work Ombudsman has guidance on long-term sick leave.


It's not an ATO matter 🫢
