I'm a new PR and new to the Australian work force.

When I started employment I was asked to select a Super fund and I did so, but I did not have a member number (not sure if this was requested or not in the process).

I also selected salary sacrifice.


For the past 6 months, I've been getting payslips with super and salary sacrifice deducted.

But only recently I relaized my super was not paid to ATO.


When asked from the employer, this was their response.

 

"It is the employee’s responsibility to ensure that superannuation information is complete and up to date to enable timely super contributions. As a result, could you please update your super member number in Deel and confirm once this has been done, so that we can process your super payments upon your confirmation."


I'll create an account and share info, but not sure if this is actually legal and if they should pay super + salary sacrifice + interest lost.

Yes, the Choice of Fund form you completed requires you to identify your super member account, not just the fund 😉


However, employers are required to pay super each quarter. Your salary sacrifice agreement should specify how often they will pay those contributions.


Follow the steps in the ATO guidance for reporting your employer for failing to meet their super obligations 🤓
