For a sleep technician on the Health Professionals and Support Services Award 2020 employed as a casual employee, generally doing 3 overnight 12 hour shifts per week, how is the super (SG) calculated?

Since the award dictates that any hours over 10 hours in a shift are overtime, the employer has advised that they only pay super on the first 10 hours of each shift. If this is correct, it seems incredibly unfair.

Can someone please advise? With thanks in advance.

Hi @ann3

I recommend getting written advice about this situation from our Early engagement team.

Hi @ann3,

Super guarantee is payable on ordinary time earnings. As overtime is not an ordinary time earning by definition, super guarantee is not payable on this amount.

You can see what is classed as an ordinary time earning on our checklist: salary or wages and ordinary time earnings on our website.

Thanks Blake. Looking at that link, I'm trying to understand which is relevant to the sleep technician job. As a casual employee, it seems to me that "No ordinary hours of work stipulated" would be relevant where all hours worked are included in OTE?
