Hi ATO team, I am a bit confused about how to get a refund of the over-withheld dividends tax from US stocks. I use a broker called 'eToro' and when eToro gives me dividends they do it with a 30% withholding tax rate and tell me I have to contact the local tax office to get the 15% off.


From my understanding, I thought ATO will be the one who will give me the tax refund, not the IRS. I thought when I fill in 'foreign income tax offset' information during tax time, ATO would refund me. but from the previous question I asked @BlakeATO answered that I need to talk to IRS. But, I have already received some of the dividends and just need to get a refund of the 15%. Do I still need to contact IRS?

(Also, I have checked IRS tax form 1042 and form 1042-S. They were way too complicated for me to understand all the codes and terms. I need some help)

The US companies you have invested in via e-Toro have withheld 30% tax from your dividend payments because you did not submit form W-8BEN-E.

Without that form being lodged with the IRS any US company is required to withhold 30% from dividend payments to non-resident foreigners.


The IRS will refund the additional 15% tax that has been withheld once you submit this form. You should be able to do that through the e-Toro platform. I'd suggest you contact their customer service centre to find out the process to do that.
