Hi All, we have 3 directors in the pty ltd company, one(She) of them was an Australian resident for tax purposes, the others are foreign residents. December 2021, she decided to move back to overseas and she did move overseas, and applied for the change the non-Australian resident for tax purposes. However, She was still listed in ASIC as the only Australian director of the company. The company now need to apply for funding facility for business purpose, and she is the only one who could apply for this facility. Will the application for funding effecting on her status of Non-Australian resident for tax purposes?

It won't impact her tax residency. We look at several factors to work out tax residency, so just one won't change it.


You should, however, check the requirements with ASIC for when all directors are non-residents, and with the entity you apply for the funding through.
