Can I get some help on if my accounting fees are deductible? New accountant says they aren't.


- ex accountant lost tax agent licence in mid 2021, I think May or June


- told me his business could still lodge tax returns and give tax advice because of change in business structure


- got and paid for 2021 company tax return and other things invoice in September 2021, no change in invoice from before. Same ABN, that belongs to individual ex tax agent accountant above


- new accountant says because he wasn't registered tax agent my company can't claim a tax deduction or GST - is that right?

Your new accountant is right. You can't claim for the cost of tax advice/services given by a person who isn't a recognised tax adviser.


A recognised tax adviser is a registered tax agent, barrister or solicitor. You can see a list of registered tax agents on the Tax Practitioners Board website.


You can claim GST credits for business purchases but the supplier needs to be registered. However, this is a unique situation. I recommend searching for their ABN on ABN lookup to check if they're registered. If they are then I recommend getting in touch with our GST team at GSTmail@ato.gov.au to check if you can claim in this instance.
