Hi,


My husband is a sole trader (window cleaner) and has a work van. I work part-time Sat & Sun with a different company, however will begin working with him Mon - Thurs due to demand. We will now need to purchase a second vehicle (ute) for me to also attend jobs.


A few questions please:


Does the instant asset write off apply to the second vehicle?


If yes, would the ute need to be put under his name as he is the ABN holder? The van is already in his name.


Come tax time, can he claim 100% of the window cleaning earnings including the two vehicles under his name? Or is he required to pay me a salary and turn the business into a partnership?


On my tax return, would I need to declare anything additional or just my usual part time salary.

Instant asset write off won't apply it'll be temporary full expensing. If your husband is eligible to he can claim for the vehicle he purchases for the business.


If you've earned the income it should be declared by you. There are a few options -


  1. your husband can employ you as an employee
  2. you work as a sole trader
  3. you and your husband form a partnership


If you're an employee you'll declare your income as salary and wages. There's a separate part for sole traders and partnership income.
