I am currently employed as a Licensed real estate agent working on a commission only agreement for my employer. My question is, given that the REIV states on their website commission only employees must have super paid on top of commissions earnt - is this correct or is there a way an employer could have it deducted from the commission?

Your employer needs to pay super guarantee on OTE, this includes commissisions and allowances. You can check out the SG table the employers need to use when working out what they pay super on. Casual work, piece work and commissions are listed as OTE and should receive SG. Your employer should be paying it on your commissions. Did you sign a contract prior to commencing with them the super would be taken from the commissions?
