Hello, I currently live in the UK and I am going to be working remotely for an organisation in Australia. I am a dual citizen and I will have the payments made into my Australian bank account and super accumulated in an Australian fund. I will make occasional trips to Australia and may more back there in the next 12 months. How will tax arrangements work, do I need to apply for an exemption in Australia and then pay the tax in the UK or the other way around? Any links to forms that I need to complete would be great.

Hi @dgoodwin,


If you're a foreign resident performing the work overseas, the income will be deemed foreign-sourced. In this regard your Australian employer will not have to withhold tax from your employment income, nor will they have an obligation to pay you super guarantee (SG). Even if you're being paid your income into your Australian bank account. However, you and your employer may have reporting obligations in the UK where the work is being performed. You can check with the relevant taxing authority over there.

Hello @Jodie_ATO , thanks for your reply. Are you able to tell me if there is a form/ process/mechanism, for reporting my status to the ATO so that I am not being automatically taxed in Australia if I am classed as a foreign resident? Secondly, are there criteria to meet to be classed as a 'foreign resident' for Australian tax purposes (e.g. is living in the UK basically 100% of the time sufficient?). Many thanks again. Daniel.
