Hi


I have a supplier who has charged GST on their invoice but not registered. I have only made payment of the amount minus the GST and asked them to resend another copy of the invoice without GST. They have advised they are registered and its just not showing up. My question is, if they register today for GST and backdate it, do I then have to pay the rest of the invoice? Or is it now too late for them to charge GST. As of today, it still shows not registered but they may have registered today and backdated it. Any help would be great.

If the supplier isn't showing up as registered they aren't allowed to charge GST on invoices. If they do register for GST and backdate their registration, then they'll be required to pay the GST out of their own pocket.

Thank you @GabbyATO . So they can't request I pay back the GST now if they backdate registration as its past now? Also, another customer of ours paid their invoice with the GST, when they requested for the GST to be refunded, they repleid that they will register so they won't refund it. Is this legal?
