Just curious what the purpose / intention of the “genuinely available to rent” rule is? And if it’s possible to get a judgement call from the ATO considering the changed world during covid times?

Rental property genuinely available for rent | Australian Taxation Office (ato.gov.au)

Basically you can claim expenses when you advertise the property and are awaiting a new tenant.

"The absence of these factors generally indicates the owner does not have a genuine intention to make income from the property and may have other purposes"


You can apply for a private ruling, however based on your previous post, it seems pretty clear you would not be eligible to claim rental deductions for that period.
