I went through a separation last year and have just received an email saying I need to declare capital gains tax. However, I have not sold any property.


In looking at the guidance stuff on the website, the circumstances do not match my circumstances. I still own the property.


How do I report to the ATO that their records are wrong?

We get info from organisations such as state revenue offices, land title offices, the ASX, and Computershare.


Those types of letters can be an FYI. Have you transferred any assets to anyone else even if you received nothing for it? We send out different types of letters like that and don't have access to your account to check yours. If the letter has a number on it then you can get in touch with that area.

@AriATO, I have not transferred any assets, but I did get a land tax notice from ACT gov and am currently getting that corrected. So I expect this means that when the ACT gov corrects their records it will flow onto the ATO.
