If I am paid penalty rate for a public holiday. And I worked 40 hours that week, Monday to Friday. And everything after 38 hours is overtime. Do I still get 2 hours overtime?


Or is the public holiday penalty rate hours considered separate from ordinary hours which case I only get overtime if Tuesday to Friday exceeds 38 hours?

Perhaps you may not be aware that The Fair Work Ombudsman is the regulator for employment matters and they have tools to assist you with questions about your pay and entitlements.


The ATO can't assist you with questions about your pay entitlements.
