I’m advised by the ato that even though downsizer non concession contribution for a couple does not count towards the carry forward limit, the $120k per annum limit still applies it I want contribute again this financial year can I get some clarity please

The downsizer contribution does not count towards either your concessional and non-concessional contribution cap. But you need to ensure when the contribution is made that it is recognised as a downsizer (ensure the election form is provided to the super trustee before or at the time of the downsizer contribution).
As the downsizer contribution does not count towards either cap - a non-concessional contribution can be made in addition (assuming you meet all the eligibility requirements). There is no reduction in your contribution cap due to making the downsizer contribution (but as mentioned need to ensure the election is made in the appropriate timeframes).
