Releasing excess concessional contributions (ECC) is a process managed primarily through the Australian Taxation Office (ATO) after the end of the financial year. I cannot proactively "withdraw" excess contributions yourself to fix the issue. I was advised to wait for the ATO to identify the excess and send me a determination.

I had $620 excess concessional contributions (ECC) in my last financial year tax return. After waiting for 10 months after last financial year ended, I still haven't gotten the notification to release excess concessional contributions (ECC) from ATO. What can I do?

Hi @evang79,

You’re right that excess concessional contributions (ECC) are managed through us after the end of the financial year, and you need to wait for an ECC determination before you can elect to release amounts.

There isn’t a set timeframe for when these determinations are issued. They’re sent once we’ve received and processed all contributions data from super funds and employers for the year, which can take some time. In some cases, delays can occur if reporting is late or needs correcting.

What you can do now

  • Check ATO online services to confirm the concessional contributions info we have on record matches your super fund statements.
  • If the contributions data looks complete but you still haven’t received a determination, you can call our super team to ask whether the ECC process for that year has finished or if anything is outstanding.
  • If you believe the excess has arisen due to special circumstances, you can apply for an excess contributions determination asking us to disregard or reallocate contributions.

Until a determination is issued, you won’t be able to make a valid election to release ECC.
