I received $20000 from my super fund under early release for compassionate grounds (dental) however between applying and when I received the funds I was harassed by the dentist and Supercare with phone calls and in the end decided to look for alternative providers for my dental treatment. In the end I misspent the funds on bills and general living and want to advise the ATO. My question is how do I do this and what are the repercussions (ie penalties) I am fully prepared to return the funds to my super account once I return to full time work

You’re doing the right thing by being upfront about this.


You can speak with our super team to explain your circumstances or make a voluntary disclosure in writing. Doing this early can help reduce any penalties or interest that might otherwise apply.


In terms of the money itself, the early release can’t be undone once it’s been paid out. You can recontribute to your super later, just keep in mind any repaid money is treated as a new contribution, not a reversal of the original withdrawal.


The main practical impact is that the amount you received is likely to be treated as taxable income for that year and taxed at your marginal tax rate.


Also, the experience you describe with the dentist (pressure, repeated contact) is something you could consider raising with Ahpra. They regulate health practitioners in Australia and can look into those kinds of concerns.
