Tenants left alot of damage; pool filter was squirting out water on final inspection. Can this be claimed as a repair? The house was empty for a while after tenants moved out to enable repairs and owners then moved back home. So if not repairs ...can it still be claimed as depreciation if no longer rented?

When it comes to repairs and maintenance, you can claim the expense in the year you incur the expense.

Pool filter is generally depreciatable asset, however as it was found broken as the tenants vacated .. and the owners then moved back in. Can the asset be depreciated over its useful life even if the property is no longer rented. Or in this case can it be a repair as it is bringing property back to previous condition before tenants? Otherwise the owner misses out on a deduction for something to tenant damaged.

What they're effectively looking at doing is replacing something that was damaged as a result of renting their property out. To be eligible to claim the replacement at repair and maintenance section of their tax return, they'd need to continue to rent the property out or it needs to be available for rent. Because this isn't their intention, they don't meet the eligibility criteria.


Have a think about depreciating the filter over a number of years and then the possible option of doing a balancing adjustment when the property stops being used to earn an income.


It's a great idea to keep all receipts in case the value of the filter forms part of the cost base for capital gains tax purposes when it comes time to sell the property.
