Hi Folks,

I'm looking to apply for the FHSS scheme and have come across the question regarding an interest in property. I made a decision with my partner 2 years ago to look into purchasing rural land with the intention of building a home on that property. For ease of searching, I believe it fell under this condition.

  • where you have signed a contract for land or your home even if settlement has not occurred

The contract however, did not go unconditional as we were quite skeptical as to whether a home could be built. We had put a condition in the contract subject to due diligence and on further investigation, discovered that there were numerous issues with the land which prevented us from building a home on that property. After 3 days, we pulled out of the contract.

I'm now (hoping) that these circumstances have not hindered my ability to access the FHSS scheme, but would really appreciate whether the conditions we'd placed in the contract still deem me eligible to apply for the FHSS. Essentially, we were told verbally that we could build a house, which is why we placed that clause in the contract to be certain.
