A forestry worker is required to bring into work each day two separate backpacks which contain different equipment and supplies for different situations. Therefore, depending upon the situation that they are faced with will impact which backpack they will need. But they need to bring in both packs irrespective each and every day that they come into work. Their travel however, is just between home and work.
Are they able to claim car travel between home and work in this situation?
The packs are essential for work purposes containing all the materials, supplies and equipment that they may need when out in the bush/forest etc. They are bulky and heavy packs e.g. a 40L bag containing chainsaw parts and other tools & equipment. The worker must pass a fitness test every year to remain employed to ensure that they are able to keep up with the intensity of the physical demand of their work. Because they need to bring two packs it would be awkward and inconvenient to transport both without the use of a motor vehicle. There is no secure place for employees to store these packs at their workplace.
Again, would an employee in this situation be able to claim car travel between home and work due to having to transport bulky items?
