What do I if I don’t have a valid address to enter to notify of a signed contract for the FHSSS? We’ve bought a block of land so have the street name and lot number but not the actual address and the address input on the notifying form won’t recognise it.

Hi @Firsthomeowner,


Your questions have raised some key points which we thought would be a fantastic opportunity to share with the whole ATO community!


We don’t know the full circumstances, but for the purposes of this exercise and to keep it simple, let’s assume you meet all of the FHSS eligibility criteria, etc and fall into one of the two categories below:


A.     Signed a contract to purchase a block of land and going to find a builder separately to construct your house or

B.     Have signed a contract for a house and land package.


If your scenario is different to the two scenarios above, please let us know.


Remember, in both scenarios below make sure to have a FHSS determination before you sign a contract resulting in you obtaining an interest in property, this includes vacant land.


A.     If you have purchased land but not signed a contract to construct a house yet, you do not have to do anything now.


When do you need to notify us? Within 28 days of entering into the contract to purchase or construct the residential premises.


Note: In this scenario, if you have purchased vacant land (after requesting a FHSS determination) you will need to enter into the contract to construct the premises from 14 days before you make a valid request for release until 12 months after the day you make a valid request for release. If you don't sign a contract to purchase or construct a home within 12 months of the date you requested a release, we may grant you an extension of time to do so for a further 12 months.


Remember, the purchase of vacant land alone within this period is not enough to satisfy the requirements to notify contract to purchase or construct the residential premises under the FHSS scheme, the important part is the contract to construct your home which is important for notification purposes.


B.     If you have signed a contract to construct your home and also signed the contract to purchase the land (house and land package), then you can notify us with the details.


When do you need to notify us? Within 28 days of entering into the contract to purchase or construct the residential premises.


If a street number has not been assigned, you can provide the lot number when making the notification that you entered into a contract to purchase or construct your home.
