Hi, I inherited a property a few years ago and have had tenants living there for 7 years. I'm planning to move into the property and make it my main residence. If I were to sell it some time in the future would I need to pay CGT?

Disposing of inherited assets:


Generally, capital gains tax (CGT) does not apply when you inherit an asset.

When you sell an asset you have inherited, and the asset is:


  • not a property, the normal rules apply for calculating your CGT
  • property, such as a house, it may qualify for the main residence exemption from CGT
  • collectable or personal-use asset, the normal rules apply – that is, the asset is subject to CGT unless it was acquired for less than the thresholds for these types of assets.

You will need to look at the entire history of the property, not just the period after you inherited it.


Based on the limited information provided it appears some CGT may be payable.
