Hello,

I have an EV on a Novated Lease with my employer, and only recently became aware of my ability to claim the 4.2 cents per km for home charging. The leasing company however has denied my claim, stating that they have no direction from the ATO to appy this form of expense. Their customer service leaves alot to be desired, so I thought I'd do some digging on my own about this. Can you confirm that this can be claimed now (as of 30th October 2023), or because this is still in draft it technically can't be claimed right now? Thanks in advance, Darren.

The draft is able to be used as direction, so yes you can claim.

Hi Catherine, Can you please let me know the process for this? Like the original poster my novated lease company (Maxxia in Victoria) is refusing my claim at 4.2c/km as they say the ATO has not finalised this. I also tried to claim the exact power usage for charging my EV at home by sending them the charge logs (details of this included time of day and total kWh charged) from my EV wall charger (which of course can only be used to charge the vehicle) plus my power company's welcome pack showing electricity costs per time of day. They said I needed a completely separate power connection to the house including separate electricity meter to claim in this way. I would doubt anyone would go through the installation expense and extra daily charge for a completely separate meter. Thanks for the advice

Albeit a draft, the ruling is to be followed as if it were finalised. The information on the draft is current, and what should be followed to meet compliance. On the draft it tells you if the draft can or cannot be followed, in this case, it should be followed.


We haven't heard of the requirement for you to obtain a separate charging station. You can ask the provider to provide you with the legislation that mentions this. It would be easier to work out the costs involved if it were separate to the home power supply, as there wouldn't be home usage taken into account! That may be their preference, but it isn't a mandatory requirement.

Hi Catherine, I too have a Novated Lease for an EV through Maxxia in SA and just today, have been told that the 4.2c per km is not able to be claimed at this stage as it has not been finalised thru the ATO.


Do you have any link that I could send to Maxxia in my email exchanges so they can come into line with other companies and make thing a lot easier for us?

Hi Catherine, I am another person who is struggling to get Maxxia (NSW) to comply with the now approved Compliance Guideline PCG 2023/D1. They are now refusing to process any claims using the 4.2c/km method prior to the date the guideline was officially approved Feb 2024 even though it clearly states that it applies from 1st of August 2022. Is there a way of making an official complaint against companies not following the guidelines?

They shouldn't be refusing. If you'd like to make a complaint first go directly to their complaints area and they'll be able to point you in the right direction if they can't resolve it for you.

Thanks for your response. I still haven't had any movement from Maxxia. Every time I contact them they say they need to raise it further and that they will get someone to call me back which they never do, I have gone through this cycle about 3 times so far. I just get a email response saying I can't claim using the 4.2c/km method prior to Feb 2024 without an explanation. Do you have any other suggestions to raise the issue?

Same here. They keep refusing to acknowledge the PCG and say this is their policy. But refuse to give anything in writing. Transfer from one person to another and repeat the same thing.

Have you been able to do anything about it yet? Maxxia have sent an email to me saying 'I am not eligible to claim both commercial and hone charging' and they refuse to cite a rule/legislation they are following.

Nope, still in the loop hole of them avoiding having to explain their actions. Very frustrating, I have had many issues with them but have no other leasing options as Maxxia is the only company my workplace (gov) approves.

I have now been told by maxxia that they have been advised by the ATO that they can't approve claims using the 4.2c/km method prior to Feb 2024 as you need evidence of an odometer reading proving the km you have used for the claim. This makes no sense, my car was new when I started my lease in 2023, I have the odometer reading on the invoice for the car this was all within the time frame of the dates in the guidelines. They refuse to reference any legislation or documentation they are getting this advice from just "that there were advised by the ATO". Is there a way to raise this complaint further via the ATO?

Have you had any success since with maxxia? I too am stuck in this loop with them about requiring an odometer reading prior to Feb 24 on a brand new vehicle delivered with 0 km.

They went backwards in the most recent reply. 'Produce tax invoice from a separate meter' if you want to claim home charging'. They still claim this is the most up to date instruction they have from the ATO. They refuse to acknowledge the existence of PCG 2024/2.
