Hi,

are TSS 482 dependant/secondary applicant visa holders allowed to set up new pvt Ltd company in Australia and do e-commerce business through it? The visa is a temporary skill shortage and mentions " must only work in nominated occupation". There is no more specification about that on the home affairs website. Just my my hubby has the nominated occupation and I am on dependant visa.

Or does it make more sense to run the business as a sole trader with the ATN? Or is it at least permit to sell products online as TSS 482 dependant visa holder in Australia?

Thank you for any advice or tips.

Hi @Beti

I would love to help you out on this question, however it’s one Home Affairs can only answer.

Department of Home Affairs set out visa conditions, it’s important you continue to meet these. If operating your own e-commerce business falls within visa conditions our concerns will be around the entity meeting their tax and superannuation obligations.

The business structure so company or sole is a choice the entity has to make themselves we decide this either. If you’re uncertain speaking with a legal practitioner or registered tax agent would be the best option for advice.

You can find more info on under Business structures and what tax responsibilities they each have can be found on our Business structures – key tax obligations page.
