In order to get foreign withholding tax refunded to me from Switzerland, I need to fill out a form:
Application for refund of the withholding tax on payments by pension funds domiciled in Switzerland
The form has a section (page 1 bottom) requiring the foreign tax authority (i.e. the ATO) to confirm that: "the aforementioned payment has effectively been taxed (enclose proof of taxation)".
I understand that I would need to use the Overseas Tax Relief for Individuals form @ https://ato.gov.au/overseastaxrelief.
There are two separate questions I have about this form:
- The following condition applies to my case: https://www.ato.gov.au/individuals-and-families/super-for-individuals-and-families/super/foreign-super-funds/withdraw-a-lump-sum-directly-from-a-foreign-super-fund#Within6monthsofbecomingaresident. The tax applied to the pension lump sum should be zero. Is the ATO able to complete their section of the Switzerland refund form, enclosing some kind of "proof of taxation" of $0?
- The ATO Overseas Tax Relief form's Q11 is asking to "Indicate the time period and year the request is required to cover". How do I answer this, given that I went from being a tax resident of Switzerland to a tax resident of Australia on some particular date? Which "period" do I specify?
