I am needing to know a person's tax status.

The person was originally on an Australian PR and holds a middle eastern passport, he began work in Australia (tax normally as Australian resident) then moved to UAE, and wants to stay there permanently. The employer is Australian based.


1) Would this person now be a non-resident/foreign resident whereby they will still be taxed under the foreign resident/non-resident tax rates? (although Medicare is exempt)

or

2) Would their Australian income be considered 'Foreign employment income', where tax and super is exempt? i.e. tax in no longer withheld.


I've looked online and there is no clarity on which way to go


Would appreciate the help.

Going off what you've said here they seem unlikely to be an Australian resident for tax purposes. You can use our residency tool to work this out yourself too.


If they're indeed not a tax resident and are performing the work overseas then they'd have no tax or super responsibilities here.
