I am a temporary visa holder (resident for tax purposes) who has never departed Australia, except for holidays whilst holding a valid 'multiple entries' visa.


If I obtain permanent residency in Australia, will the super I received whilst being on a temporary visa still be subject to DASP (for example if I were to claim my super when retiring as an Australian resident living in Australia at age 60), or does DASP no longer apply to any prior contributions once I obtain PR?


In other words, will a temporary visa holder who becomes a permanent resident in Australia enjoy the same super entitlements as all other Australians, no DASP for contributions made as a temp?

Hi @tapasandolives,

 

You can't claim your super under DASP if you're a permanent resident of Australia, including any contributions made while on a temporary visa as these won't be split up.

 

Your super will stay in the superfund until you're eligible to access it.

Thank you very much Mel. I have reviewed the similar post you mentioned and the advice given there.


I have two follow up questions that I am not entirely clear on yet and would greatly appreciate your confirmation.


If a temporary visa holder becomes a permanent resident, but then returns to live in their home country/or another country prior to the age of 60, do they then have to pay DASP?


Alternatively, if a temporary visa holder who became a PR leaves Australia as a PR to live overseas, after becoming eligible to access their superannuation in Australia, can they continue to access their Australian superannuation from overseas without having to pay DASP?
