Hello,

I was granted the Skilled Work Regional (Provisional) visa (subclass 491) visa for South Australia. I am currently living and working for a company in Dubai, United Arab Emirates, which is a tax free country.

My question is if I would like to move Australia (Adelaide), and continue remotely there for the same company that is based in Dubai, keeping the same overseas employment contract. How does it work from a tax perspective? Can I just pay the taxes myself in Australia, or my employer has any obligation to hold any amount from my salary or pay any taxes themselves? If they have any obligation or must hold any taxes, how can they do it and transfer it to Australia Taxation Office? Do they have to bear any cost to do so?

Also, do they have to pay me super-annuation or is it option as it is an international company. If they have to pay it, does it need to be indicated in the salary payslip, or I can calculate it myself when paying the taxes.

Note my company has an office in Melbourne, but I would like to keep the same contract I have in Dubai, and not have any ties with the company branch in Australia.

Looking forward to hearing from you.

Thanks

Hi @Ramadan,

  1. At some point, while you're in Australia you'll become an Australian resident for tax purposes. This means when you lodge your tax return, you'll need to tell us about your world-wide income. We'll work out the amount of tax you need to pay.
  2. Your employer won't have any Australian tax obligations.
  3. Yes, your employer will need to pay you super guarantee.

Hi there, I’ll be moving to Australia early next year while continuing employment with my overseas employer. As I do recruitment and project work, believe that my employer will not be required to pay corporate tax as the scope of work is not revenue generating and they will be required to pay super. Are they also required to register somewhere / regularly report their payroll for myself?

Best I can do is provide this link about remote working.

https://community.ato.gov.au/s/article/a079s000000aripAAA/what-remote-working-means-for-your-tax-return

This link provides information on income that must be declared as a temporary resident.

https://www.ato.gov.au/individuals-and-families/income-deductions-offsets-and-records/income-you-must-declare/foreign-and-worldwide-income/foreign-and-temporary-resident-income#ato-Temporaryresidentincome

While a tax resident (even if temporary) you will need to declare your overseas employment income.
