I have enduring Power of Attorney for my mother. I sent it and a form to the ATO to be made her representative and to change her address and find out her TFN. I had a call from the ATO to advise that there was a conflict of interest on the POA as the solicitor who prepared it also certified it. I've had no issues with any other govt dept or bank, even sold her house with it. My question now is, do I need to get the original POA to get a new certified copy signed by some other approved person, or can I use my certified copy only to get recertified. It seems over the too to me.

If the copy you have is already certified, you won't be able to have it certified again.
You'll need the original POA for the person certifying the copy to site.

Seems a tricky situation.
We would need to see the document certified by another person.
You can have the original document certified by someone else and resubmit the application to us. This way there is no conflict.
