I am the manager of a small business. I lodged one employee info to ATO by Xero including TFN, employment basis etc.. I wonder if ATO can send me a certified letter stating that I reported this employee's details to ATO. The letter must include this employee's name, DOB, address, TFN, employment basis, start date and end date.

Thank you

@Jinbao, just because you reported the Employment Basis as F in the STP pay event does not mean that the ATO has any role whatsoever in this dispute.

When you issued the Employment Contract to your employee, as required by the Fair Work Ombudsman, you would have stated the basis of their employment as full-time. When the employee completed their TFN Declaration and nominated their employment basis, they would have selected full time.

The ATO doesn't have a role in proving that you consider the employment basis to be full time. Employment matters are for the Fair Work Ombudsman.

Hiya @Jinbao 👋

For what purpose is this required? Is it because the employee wants a Confirmation of Employment from their former employer? In which case, you are required to do that and send it to the former employee but you MUST NOT include the TFN on that letter.

Or is it because you want confirmation that you lodged your STP pay event successfully? In which case, that confirmation will be in whatever product you used to lodge it.

If the employee wants to know if you've reported their income to the ATO, they can log onto ATO Online and look at their Income Statement that shows the employer and the amounts. It doesn't show employment details, as that is not the role of the ATO but it is the role of the employer.

Hi Deanne,

We have a dispute with my previous employee. I reported him to ATO as Full time and he claimed he was casual. Then he quited job without any notice. I am going to deduct some wages. From Fairework website, Full-time employee needs to give notice to the employer before resignation. So I need the ATO certificated letter to prove what I did.

Thank you
