My SMSF holds shares in a US based company that is listed on the ASX. I have lodged a W-8BEN-E form with the Australian based registrar of the shares in order to have my withholding tax rate reduced to 15%. Unfortunately there have been some delays with them lodging this with the IRS so some of my dividend payments have had tax deducted at a rate of 30% rather than the correct 15% rate in accordance with the double tax treaty. I contacted the registrar about how to go about getting the over payment of withholding tax refunded and they told me to contact the ATO to obtain the refund. Any ideas about how I do this?
