Is a spouse considered a dependent for Medicare Levy Exemption regardless of their income and other circumstances?

I’m not entitled to Medicare and have a MES confirming it, but my partner is entitled to it. We live together, both of us work full time and cover our own expenses. Neither of us depends on each other financially.

Are we still considered each others dependents for exemption purposes? The example suggests that we are, simply because we are a spouse to each other:

https://www.ato.gov.au/individuals-and-families/medicare-and-private-health-insurance/medicare-levy/medicare-levy-exemption/not-entitled-to-medicare-benefits

I don’t find it fair to pay Levy on two full time incomes, while only one person can benefit from Medicare. Please help me clarify if I’m understanding this correctly.

Hi @Blueberry,

Your understanding is correct. Your spouse is considered a dependant for Medicare levy exemption purposes if you've 'maintained' them. We have more details about the maintenance of a dependant on our website.
