Hello! I am Australian citizen based in Sydney and I will work as a contractor Business Analyst for the company whose legal entity is in Germany (no Australian legal entity). They will pay me regular salary for my labour. Is it mandatory for this company to pay me super and how they can make these payments from another country? What info about my super account will they need from me to pay super contributions legally? Thanks!
Hi @Alinachi,
It depends.
If you're employed in Australia, employers are generally required to make super guarantee contributions. But as a contractor for an overseas employer, whether or not, you're entitled, you'll need to check your contract or work arrangement.
If you're considered as independent contractor, not an employee, the company may not be obligated to make super contributions. Or if your work arrangements state you as an employee, then you may be entitled to super.
The Germany company can make super payments directly to your super fund. You can provide them with fund ABN, fund name, USI and your member account number.
