Background

In the past, my former spouse and I have filed tax returns as a relationship. However, during the 2023-24 financial year, we have I ended the relationship. Our living situation remains the same (living together with no formal lease agreement). Some time ago (around 2012), we registered our relationship with the QLD government, as part of the process to get citizenship for my former spouse.


Question

Do we both file individual tax returns for the 2023-24 financial year? Are there any 'spouse' tests that I need to be aware of to ensure we're individuals and not in a relationship in the eyes of the ATO.

Well, every individual lodges a tax return regardless of whether they have a spouse or not.

Complete spouse details on your individual tax return if you had a spouse at any time during 2023-2024. Link explains what a spouse is

Thanks - that makes sense. Any ideas for what would then happen for the 2024-25 financial year? I guess I'd just mark my individual tax return with 'no spouse' or something?
