I am employed as a full time salesperson and earn a Salary plus commissions. my employer does not pay super on top of my commissions although chooses to take out the 11.5% out of my commissions and pays that portion.


This is noted in my contract.


I would like to know is this legal? even if it does form part of my contract?

It depends. Usually, super is on top of ordinary time earnings (OTE) which includes commissions. But it can be deducted from your commission if that's in your contract.


We always suggest having a chat with your employer in these cases to find out.
