I came to Australia in March 2024 on a WHV 417 from UK. I have a 12 month lease on an apartment and have stayed in one location since then. I have also been in the same job since I started. I am lodging my tax return. I got advice that I was an Australian resident for tax purposes but my tax agent has put me as non resident as the pre fill on the ATO tax report was non resident. She says it’s because  of my intention at the time he applied for the working holiday visa, specifically what was filled out on the application rather than my current thoughts. Is this correct?

Not that's not necessarily correct, however working out your residency can be different when on a WHM visa. Coming to Australia on a WHM visa usually means that you don't intend to stay in Australia.


If you intend on making Australia home, then yes, you'll be an Australian resident for tax purposes. If not, then you'll be a foreign resident for tax purposes.
