my partner and I earn enough to put us over $180,000 and we have been living together for over a year. He has PHI and I do not. After tax return this year, he was charged $1900 in Medicare levy surcharge because I don’t have PHI. I’ve been told this is because he claimed me as a dependant. If I’m working full-time earning over $100,000 per annum, paying my own bills and funding myself, is he allowed to claim me as dependant?

yes as you do not have PHI you would be considered a dependent as per Family and dependants for Medicare levy surcharge purposes | Australian Taxation Office (ato.gov.au)
