I am seeking advice regarding unpaid superannuation contributions from my former employer, which has now gone into liquidation as of 2 July 2024.
Background:
- I was employed from October 2020 to March 2024.
- My annual salary was $70,000 + super, and based on my payslips, the employer reported total super contributions of $21,505.85 AUD.
- However, only $11,622.14 AUD was paid into my super account, leaving a shortfall of $9,854.41 AUD.
- The ATO investigated the unpaid super but closed the case due to the company entering liquidation and referred me to the liquidator.
My Actions So Far:
- I have completed and submitted Form 535 (Proof of Debt) to the liquidator, along with supporting documents (e.g., payslips, superannuation statements, and a discrepancy report).
- I also attached the ATO letter confirming the investigation closure.
My Questions:
- Is there anything else I should do to strengthen my claim and ensure the liquidator considers it fairly?
- If the liquidation process does not recover sufficient funds, are there alternative options (e.g., Fair Entitlements Guarantee) for unpaid super?
- Has anyone dealt with a similar situation and can share their experience or outcome?
