I turned 60 in January 2025. My Super company says you must be 60 and 39 weeks before you can access the full sum, I am currently without any job. I am in bankruptcy and this finishes July 2025. The law says I can access super while in bankruptcy (but not before) and its protected by law? We are in financial hardship and have not received any government assistance simply because everytime we have received any assistance over the years it always ended in a pay back and I do not want the stress, instead we drew down on our savings till now we have none and in real need.

I am unsure whether to apply for fund release on the grounds of financial hardship which may have me jumping hoops to prove everything and receive part payment only or simply ask for the full sum now being 60 years old and not working? any thoughts would be appreciated.

Do other super funds have the (and 39 weeks) stipulation?

I am so sorry this is happening to you. Sounds like you have reached your preservation age so you have to wait till you are 60 plus 39 weeks. The other big elibibility criteria is that you have to be on government support for 26 weeks - continous.

The only positive news is that because you are over 60, if you are not working you can access your super.

The only positive news is that because you are over 60, if you are not working you can access your super.

Thanks for your response, much appreciated. Now that I'm 60 and not working, will I need to wait for the 39 weeks to pass? I'm thinking of asking for early release due to severe financial hardship.
