Hi Everyone,

I have a question regarding Superannuation Guarantee and when to report late payments.

My employer has failed to make payment to my Super fund for the period 01/10/24-31/12/24 by January 29th 2025.

I have contacted my boss and the business' accountant, who had replied to me telling me verbatim "Lodgements and payments to the relevant organisations will take place within the allotted ATO time frames. Please can you advise if you do not see any payments after the 28/02/25 so that I can follow it up."

My question is this: if the payment has not been received in my account on or before the 29th of January 2025, does that not mean that it is now classified late, regardless of when the business has lodged it?

I have told them to lodge an SGC statement, but I feel like they're attempting to manipulate it to seem like the deadline for payment to arrive in the super account is 28th of Feb, not 29th of Jan.

Any help would be great, or an ELI5 if I'm somehow confused.

Thanks.

I'm guessing this is a small business?

GST and PAYG is due 28 Feb, so businesses will often (incorrectly) use this date for super as well, as the owners/bookkeepers/accountants want to prepare these things at the same time to increase efficiency. So you are technically correct, but assuming it is paid by the 28/02 you are talking about a very small amount of interest.
