Hi,


I contributed money to my super as part of the FHSS scheme and then purchased a home, but without withdrawing from the FHSS scheme at the time


There were changes to the law to allow people like me who had purchased a house without exiting the scheme to withdraw from the FHSS. The ATO website (linked below) says ;

"There is a period of 3 years from 15 September 2024 to 14 September 2027 for eligible previous applicants who now own property to access the scheme.

We will use the information we hold to consider whether you can request a release under the FHSS scheme. If you can, we will contact you to confirm that you still wish to use the scheme and whether you want to submit a new release request. You don't need to contact us."

I have not submitted a release request, but have a determination from that time frame. Do I need to submit a release request now or will I be contacted by the ATO regardless. When can I expect to be contacted?

According to the ATO’s guidance on the First Home Super Saver (FHSS) scheme changes, you do not need to submit a release request at this stage. The ATO has stated that they will proactively review their records and contact eligible individuals who previously applied for a determination but did not complete a release request.

What This Means for You:

  • Since you already have an FHSS determination from the original timeframe but never withdrew the funds, the ATO will identify you based on their records.
  • The ATO will contact you directly to confirm whether you still wish to withdraw under the new rules.
  • Once contacted, you may need to submit a new release request if you decide to proceed with withdrawing your FHSS amount.

When Can You Expect to Be Contacted?

  • The ATO has not provided specific dates for when they will begin contacting eligible individuals, but the eligibility period runs from 15 September 2024 to 14 September 2027.
  • Contact may occur anytime within this period, but likely soon after September 2024 when the new rules take effect.

What You Should Do Now:

  • You don’t need to take action unless you are contacted by the ATO.
  • Ensure that your myGov account details and ATO communication preferences are up to date so you don’t miss any notifications.
  • Keep records of your FHSS determination in case the ATO requests further details.

If you do not hear from the ATO within a reasonable timeframe after September 2024, you may choose to contact them directly for clarification.

Thanks for taking the time to reply. I was able to find this info in the ATO documentation and it seems that it's pretty light on detail here unfortunately.

Being that it's February of 2025 I would have hoped to receive at least some communication by now (even if just to say they're aware of the situation)


Perhaps this is something that the ATO mods can clarify on when we can expect to be contacted
