Hi there,


My superfund withheld tax at the maximum rate on my super due to not picking up my TFN from my new employer - on consultation with the super, they indicated that I now have to claim back this amount from the ATO.


Given this directly effects the super and not income tax, I am unsure of how to go about claiming this back as I don't intuitively see how this can be done on the lodgement.


Would appreciate some guidance.

Hi @ChasingSherlock,


The easiest way would be claiming it back on your 2024-25 individual tax return.


Under, item 11 label V:

  1. income section of your tax return
  2. item 11, dividends
  3. you'll find Label V, TFN amounts withheld
  4. add up all the TFN amounts withheld that haven't been refunded to you.

If you're unsure how much was withheld when you didn't have your TFN, it might be best to ask the superfund for the account statements.

the question @ChasingSherlock is asking is in regards to superannuation fund withholding tax due to no TFN, the answer quoted is in regards to dividends. @KaraATO is your response correct? it doesn't seem to make sense to me. I'm a bit confused


I have a similar query where an individual has a no-TFN tax debt within their defined benefit. The no-TFN debt arose early in their membership period, the fund has had their TFN for the last 20+ years.


The liability will be paid to ATO once the member claims their defined benefit, happening soon. Is there a way to claim back this $9,000 in taxes?
