My husband has a DVA Gold Card and is Medicare Levy exempt. This financial year we have been advised by the accountant that my husband will be liable for the MLS as our combined income exceeds the threshold and I don't have private health. Other answers on this forum seem to contradict this. Am seeking definitive advice about my husband being MLS exempt and if so, references to confirm.

From ATO website

"If you fit in one of the following categories, you're exempt from MLS for the whole of 2024–25.

Surcharge exemption categories

  • For the whole of 2024–25, you and all of your dependants (if you have any), either
    • have an appropriate level of private patient hospital cover
    • are in a Medicare levy exemption category (see question M1)."

So as you don't have private health insurance then you and your husband will be subject to the surcharge.
